As a legal professional, I wish these law professors and former judges would stop trying to make the argument that this could be criminal. It's totally off-base and it's embarrassing that they don't get it.
The standard is whether the action was so far outside of the reasonable expectation of the player who is consentually playing the game that it becomes a battery rather than a football play. The Saints weren't doing anything more than playing football. They werent using weapons . They werent making extremely illegal hits or doing anything that was so far outside of football that it was criminal. People get hurt in football and sometimes it's intentional - its always been that way and that doesn't make it criminal.
This is the dumbest thing I ever heard in my life if something like that would pass, then what... athletes will have worry about being prosecuted if someone happens to get hurt ? A basketball player will get jailed if he commits a flagrant foul, an MLB pitcher will get escorted out of the stadium by police offers if he hits the batter while pitching. I mean where do you draw the line ? This whole thing is getting really ridiculous.
