New Orleans Traffic Camera - Turning Right on Red

I got a citation in the mail yesterday. The images clearly show me taking a LEGAL right turn on red. Yet they are requesting that I send them $135 for failure to respect a red light. This is so utterly stupid that I'm inclined to rip up the papers and throw them away.

I've heard that direct communication with the managing organization in effect confirms your reception of the letter and legally binds you to pay the fine. Is it better to ignore it than try to fight it? In what ways can they harm me?

I paid mine and it was the exact same thing, not a full stop before turning right. I talked to my insurance agent (a buddy from High School) and he said basically that you can fight it and you might win. However, if you lose, you pay the fine, the court costs and your insurance company finds out about it and may increase your rates. If you just pay it, it never goes any further than that. It's a wonderful racket that traffic camera company has. Almost mafia-esque.

There is basically no way to fight it. If you get one you either pay it or you don't. If you don't pay it, it's not a criminal offense, but it would go on your credit history and could mess you up in the future. How much I don't know. In the end, no matter how annoying it is, it's probably best to pay it.

I got one a few months ago for speeding through the intersection of Carrolton, Palm and the Interstate. I was in the middle of the intersection, which is a wide intersection doing the speed limit when the light went yellow. I was not going to be able to stop without stopping in the middle of the on ramp to the interstate and/or without locking up my brakes and having the person right behind me crush in my rearend, so I sped up to get through the intersection and got a ticket for 10 mph over. Now if a Cop saw that he likely never would have written the ticket since it was safer at that point to accelerate through the intersection, but the camera doesn't care.

Of course, there is no way for the camera to show if you did or didn't come to a complete stop so you just get the ticket.

My m-i-l recently got two tickets within less than a minute of each other on South Carrollton. She called the number on the tickets and was told that it was not a clerical error because she was picked up by two different cameras. My husband's an attorney who was going to go contest it for her. However, after speaking to a couple of friends, he decided not to because the odds were greatly against the possibility of winning. I think that the process requires that you go to some type of administrative court, and you do not have the option of speaking to the DA and making a deal like you could in regular traffic court.

I also vaguely remember my husband saying that he was going to try to contact the attorney who filed (possibly will file?) a class action suit against Orleans Parish (and maybe Jefferson?) and add my m-i-l's name to some list....... not sure of this attorney's name though.

I got out of one but it was for speeding. I went to the hearing downtown. I told them I wasn’t speeding in a school zone, that is where the camera is, because it was on a Sunday night which it says on the ticket. The lady told me it doesn’t matter if was in a school zone, because the cameras are always on. DOINK, I thought I just wasted my time getting out here and proceeded to go with the hearing anyway. The judge pulled up the video but couldn’t find any on a website. They have to prove you were driving the car, that burden of proof is on them. Without any video, I got out of it. You can try it if you want but it really was a technical error. Good luck nonetheless.

Yeah, they usually have a close up picture of your face driving the car on the summons. If they don't have that or the video you can get out of it, but it's highly unlikely to happen. But, nice job sticking one to the man.

This and this. Go online, enter your citation number, and watch the video before deciding if it's worth fighting or not. I certainly wouldn't ignore it unless you already have a horrible credit rating because it will be reported and you will have to deal with debt collectors.

A coworker of mine was recently complaining for the same reason about getting a ticket for turning right on red from Poydras onto St. Charles. It looked harmless on the static photos, but I told her to pull up the video, and voila -- she absolutely blew through a second or two after the light turned red trying to beat the traffic crossing Poydras.

I make the same right turn every day, often on red, and I make sure to come to a super exaggerated complete stop before turning.

i wouldnt take that route..the next time you get pulled over they will probably take your vehicle..you can't schedule a date in court to see a judge..? if not..that's sad they way they are doing things down there.
