Hillary may be in violation of the Federal Records Act. If she used this private email server as her "Official Record Keeping System", she was required to follow federal records retention requirements. By destroying some records of her own accord, there is no assurance she followed Department of State official records retention policy.

There are procedure and regulations for doing so and it not apparent she did so. Check 36 CFR 1236.22 for the legal background. Violation of these rules is a serious matter even for department heads. There are many civil precedents issued in similar court cases to back this up also.

Secondly, the private email server she used was not capable of displaying or capturing the classification metadata normally found on secure government email servers. So, she is right that she did not view any classified emails. That does mean the emails were not classified. If you think she was not sent emails that contained classified information then you totally ignorant of what a department head in her position does for a living. As part of her job she had to receive classified information everyday. They have already determined that some of the emails contained information that was classified elsewhere. If she was ignorant of the fact that this information was classified, then she is stupid, negligent, or a liar. The laws and regulation don't seem to care one way or the other, See 18 USC 798. The major question is whether the DOJ has the principle and integrity to let the FBI move forward independently with this investigation without political interference. If she is so sure she did not do anything wrong, it would be best to do so in order to clear up the issue and let Hilary move on. Otherwise, this will hang over her head until Nov 2016. The obfuscation and obstruction leave a sense she is hiding something which is not good for a candidate for the highest office in the land. The last time something like this happened to this degree, Richard Nixon was in office.

If character was as much of a consideration, Bernie Sanders would walk away with 100% of the vote and no one would consider anyone else. It's about who is most likely to not **** things up worse than they already are if your pragmatic. There isn't a single GOP candidate who qualifies in that regard, but Rand Paul is close.

Disclaimer: I have zero love for Clinton and I admit I'm biased in that I wouldn't vote for her under any circumstances.

That out the way, I've been loathe to comment on the email situation cuz I don't know much about it. But, the exchange she had during the presser in LV yesterday was about as disingenuous as it gets. How do you respond to the question about wiping the server with what she said. If that's how she's gonna respond when faced with tough questions, she's gonna crash and burn at some point. She is just hurting herself more than anything anyone else is doing.
