Any sort of rape, not just the rape of a child. There's a case in Louisiana that's going to court over the conviction of a man who's been sentenced to death because he raped a girl (can't remember if it was a little girl or woman).

So, I ask you, does rape justify being put to death?
 
Too much gray area with rape. There would have to be degrees like with murder, manslaughter, etc.
 
only if the rape includes murder or attempt of such.
heck, most places are trying to cut back on death sentences because it isnt' humane.. and such.. but they sentenced for rape?
20 years on the sexual predator list after being in prison for 15-20 years, and being on that list severely limits where one can live and freedoms.. also having to go to classes and counseling for many years after prison.. but for murder you get out after 20 years and might have counseling..
 
That's a simplistic view IMO, there have been instances of consensual sex being called rape after the fact. That was the intention of my post.

lol, i worked in a club in houston, the manager got charged and done time for rape.. because the girl was into it, and then her boyfriend showed up at the club... while in the act....
 
there's also that kind where the girl is drunk and later regrets it, so she calls it rape.

and that kind where the girl is willing, but is slightly underage.
Stachatory, yeah but isn't there a loophole where if you're within 2 years (age difference) they can't charge you with rape?

Also when the girl screams rape and it's false sometimes they can weed out that they're lying. See Duke Rape Case.
 
I'm not trying to downplay the crime of rape, but with murder, you (usually) have a dead body as evidence. With rape, it could come down to a he said/she said situation, reported after the fact with little or no physical evidence. I would hate to think that the sympathy of a jury to an alleged victim could sentence someone to death. Yes, I'm aware this happens in murder cases as well.

but sometimes they cant. so that whole "theres only one type of rape" charge isnt valid. im not a rape expert, but i see that everything isnt black and white. i have a friend who was 20, dating a 17 year old, and her parents had him collared for stachatory. the charges were dropped, but still.
 
well, any kind of rape that is against a state's stachats should be dealt with harshly!
 
In the military or least in the U.S Army rape is punishable by death. I don't ever recall a case being prosecuted that way though.

All I have to say is that, if I were innocent and it was consensual, I wouldn't be very confident if that's my defense. This is a rape charge. They're a tricky sorta situation that usually doesn't favor the raper, but surely gains compassion for the victim. I'm sure you can figure out what area of me would squeeze watertight with that sort of thinking.
