It will get thrown out of court/charges dropped because the law was not enacted.

If I were him, I'd sue the pants off of somebody. I know nothing about the law, but it doesn't take a whole lot of common sense to know that you can't arrest somebody for breaking a law that has not been enacted yet.

Think of how many lives that arresting officer saved from taking in such an irresponsible citizen. These clips could have been used in a gun that shoots hundreds of rounds a minute and is only designed to kill kill kill on the basttlefield.

I think its lame, and typical, of NY, and the northeastern states area. A 10 round mag limit wasnt enough for them, so a 7 round mag limit made this arrest extra special, or something.

I hope he is able to sue them into oblivion.

2nd i'm wondering why no news sites are running this story
googling the guys name i see the link listed first then 3 pages of other pretty fringy sites citing the that first page (i stopped after 3)

I'd guess adding that he was a combat vet insinuates he has training with military style rifles.

Not sure what your search terms were but I found 3 regular news sources within 5 minutes.

According to Haddad’s brother, Michael Haddad, Nathan thought these magazines were legally made before the New York Assault Weapons Ban. When Nathan Haddad was arrested the new ban had not even been fully enacted yet.

so, so far the only authority on this infringment on this man's liberty is his brother's say so
- i'm not buying nor am i selling, but this is pretty specious for panty bunching at this point

Ah, ok. I just googled "haddad ar15" in google news. I really think the point is that they are indirectly saying that it can happen to anyone - even an army vet with special forces training.

I posted in another gun debate thread the exact question as to if I am stopped for whatever reason and I had over the limit magazines what would happen. Most that are for the proposed changes were pretty dismissive in saying you have nothing to worry about. Well I am a prepared person in the fact that I realized very early it is better to have and not need then to need and not have. I could see this situation happening to me personally.

the reason i ask the question is b/c i don't know what the "story" is
if he was breaking the law, he should be arrested
if he was not breaking the law, he should not be arrested
there is no clarity to the legal question here

but if you're asking me if joe solider should or should not be arrested - "yes if he is breaking the law like any other citizen"
AND if we continue the conversation - i would want special attention paid to ANY returning combat vet b/c of the high incidence of ptsd's and high suicide rates

Seems to me they violated his 2nd Amendment rights. Unless I am blind they did not limit the type or capacity of the firearms in it. It just suxs how much it cost to get it in front of the supreme court, he will be 200k deep in legal fees by then. A guy went to the AZ supreme court and got us the right to carry concealed in public parks cost him a lot though.

The said person has been gone for who knows how long and seen who knows what. And instead of letting them get back into a normal civilian life you wanna put em under a microscope? You might as well say If you lose your job you should also be put under a microscope. After all, theres more suicides and people shooting up work places after losing their job then there are returning vets doing it. What about kids who ha e gotten bullied? A kid gets bullied once and now he needs put under a microscope? There the ones shooting up schools after all. When does it end?

It doesnt. Let these people get back to a normal civilian life with how they choose to do so.

i made it pretty clear that i was not commenting on the specific case since there are precious few details offered. i was speaking of "joe/jane soldier"

and c'mon - i was speaking (again, clearly i thought) of ptsd - a biochemical reaction to trauma that alters the brain - as in there is no "normal" anymore

and yes i'm more concerned with getting them the treatment that they deserve/have earned then arming them if they are in a post-traumatic state

From just the facts claimed by the links in this thread, I can't see how he can be held on New York's criminal possession of a weapon in the third degree. The new ban NY just passed would make possessing those magazines a crime, but they won't come into effect until March 16, 2013.

So either there is more to this story, or it's an overreach by the local cops and/or DA's office. It's either case, it certainly seems to have been blown out of proportion by the right-wing, judging from the websites that have reposted this story.

EDIT: just did some more snooping on NY's laws -- it seems magazines with a capacity of over 10 rounds made before 1994 are banned (and have been since 1994ish).
