I think they charged him with aggravated assault. Pointing a gun at somebody and pulling the trigger when he didn’t need to basically.
 
So I got curious because I know different states define crimes in different ways, particularly murder. In LA for instance, First Degree Murder in Louisiana requires that the murder happen while committing another felony, killing a police officer, killing more than one person, murder for hire, killing kids, and a few other things.

But, apparently under Georgia laws there are no degrees of murder. There is just Felony Murder or Manslaughter. Apparently any killing with malice or without provocation is Felony Murder. Malice just means that you killed intentionally or accidentally while committing another felony like robbery, breaking and entering, etc.

Edit: Apparently Second Degree does exist but only applies to child abuse resulting in death.

So does this help with getting a harsher penalty or not?
 
As tragic as this was, I think the case for this is going to be a huge deal. Maybe not OJ Simpson levels, but this is gonna have a wide reaching impact imo. I'm also interested in hearing what the Feds have to say regarding possible hate crime charges.

Obviously I heard the 3 shots...dude was still swinging after getting shot twice from a shotgun? That's crazy.
Still not seeing first degree murder if he was engaged the whole time - not that he didn't have a right to defend himself, he absolutely did (which is what he was doing).
Voluntary manslaughter would be easy, especially if they were not allowed to make a citizen's arrest per the Georgia law. Second might not be too hard either given that, either.
I just don't see this as pre-meditated murder unless it can be proved that their intent was not to perform a "citizen's arrest" at all.

I am just not sure if people really have a good idea as to what should give rise to such presumptions, or how any such presumption can be rebutted. Take the following case as a blank slate, only assuming that the parties did not know each other and tell me if a presumption is justified. A man in his mid 20's shot an elderly couple, ages 85 and 86, in a cemetary.

If the elderly man and woman were black, and the young man is white - is that enough for a presumption that the crime was racially motivated?

What if the victims were white and the accused is black?

Same facts, but the parties are all of the same race.

I think it starts more subtly than that. For instance your opening shows that you knew the rules. You tacitly accepted them....

For a second I thought when you said "the rules" you were referring to the TOS.

Also, I noticed that one of the DA's that recused themselves cited that they worked with the accused on a prosecution of the deceased. Not much detail on that, but it does draw intrigue in that there was some personal history between the parties.

I saw this though...a gun stolen from an unlocked vehicle in front of the McMichaels’ home. But, that to me is just more evidence how irresponsible and gun crazy these two were.

This is pretty key to me though.

Arbery, 25, was jogging in his Satilla Shores, Georgia, neighborhood on February 23 when he was fatally shot.

For some, that is the excessive, nonsensical and ridiculously high bar they put in place to call something "racist", racially motivated or even speculate that it involved some bias or was racially stressed induced or aided.

"Alright, if the two dudes were wearing Klan masks, signed by David Duke, driving a Ford, not GMC, a Ford pickup, with a rebel flag that has the inscription "my heritage", while listening to post-Obama Ted Nugent, and while murdering him they used the N-word a minimum of six times, and after killing him they castrated him and burned his body and left their "Kill all Blacks" manifesto at the scene...then yes, I will concede this looks like a hate crime."

I imagine they feel it is the necessary counter to what they perceive as the growing "everything is racist!" movement, but it just comes across, to me, as another extreme and clownish. Like I get the importance of not nilly willy claiming any interaction between races to automatically involve bias, or hate. But does anyone want to go out on a limb and tell me, after watching that video, that they believe the same thing happens to white Arnold Antonelli jogging down that street? Your gut, intuition and instincts tell you otherwise, especially those of us who have spent a lifetime living it and it being engraved in our legacy and heritage. You know what it looks like. What it feels like. You just do.
