$500 fine in NOLA for not wearing a mask (1 Viewer)

I don’t want to get fined, so what is the rule here? And I am not trying to be dense, but I really would like to know the specifics so that I do not get fined. News articles are way too vague to answer this.

On NOLA’s Covid website, it says “Everyone must wear a mask or face covering when performing activities in public.”

I am a runner and have NOT been wearing a mask when I run (I am very pro mask in general, for the record). I thought when we were exercising outdoors it was ok to go maskless (perhaps that was dense as well). Am I missing a nuance to this rule? Again, I do not want to be fined $500.

Also do you have to wear a mask when walking your dog?

I have never worn a mask when walking outside or walking the dog. As long as people keep their distance, I'm cool. Of course, shopping or going anyplace inside, I always wear a mask.

I don't see why there would be a fine for running outside without a mask.

I've always understood the rule to be "when around other people", but I think you have a valid question (also pro-mask and also don't wear a mask when I exercise). I would just put a mask in my pocket.

The fine is at the police's discretion, while I imagine there will be occasional exceptions, I can't imagine the first impulse of the cop will be to give someone a full-fine without prior warning.

I like Idea of having the mask handy... so if a cop came and asked about the mask I could agree to wear one and perhaps get off.

I suspect you are right. Frankly, I don't think the fine is enforceable. It's likely unconstitutionally vague (the term of art is "void for vagueness") because the phase "personal recreation" is so vague it does not comply with due process.

That being said, it would cost more than $500, to fight it so putting a mask in your pocket is probably a good idea just in case. No cop is likely to write you a ticket if you say sorry officer forgot my mask in my pocket and put it on. But, I also suspect that this is really about Bourbon Street. They want people to wear masks in the crowds on Bourbon and that is likely the only place they will issue fines. I think the rule really means you need to wear a mask outside if you are around other people more than just passing by, but it is vague.
 
What about indoor recreation? Will Saints players be cited for not wearing masks in the Dome? What about high school volleyball players?

I think groups apply to the Mayor's office for special exceptions to all the COVID rules. It's why the Saints have had to go through the Mayor to get approval for how many fans in the Dome, etc. I think the LHSSA or the schools did the same for high school sports.
