I say next time to avoid potential hearing damage to said pansy student, use a tazer. repeatedly. I mean,w e need a new "Dont taz me bro!" video anyway.

My high school english teacher kept a Nerf football handy for such occassions. Her aim incredible, too.
 
I'd be willing to bet the kid suffered no ear damage but instead was embarrassed to have that done to him in front of the class and tried to save face by faking injury.

Actually, the thread title should be, "If you damage your student's ear drum, you can expect to be sued." The "waking" isn't what the suit is about. If he just walked over to the student and nudged him, there wouldn't be a problem. By slamming the hand down on the desk (I assume the ear in question was on the desk), the student's ear was damaged.

I'm sure the tort reformers will run this as a "wake the student and get sued" case rather than what it really is, "injure a student and expect to be sued."

I see a lawsuit, a beat down, or a class room shooting in her future. Sadly, Im not joking.

How hard does a hand need to strike a desk to produce hearing-loss causing effects? What is the recovery time for the hand?

This kid's ears would have bled in the Superdome.

While I don't really have a problem with either of these methods, if students sleeping in class is enough of an issue that they have to have these devices at the ready, it's possible that they need to reevaluate their teaching style/methods.

It was actually a basketball, which was at her desk for a completely different purpose that related to one of her many activities/projects that kept things light and fun and attempted to keep us involved. She was easily one of the better teachers I've had. But in a public high school in rural Cenla, some kids are just not going to give a ****. :idunno:
