Judge dismisses resisting arrest charge against Texans' Weary

A judge today dismissed allegations of resisting arrest against Houston Texans offensive lineman Fred Weary Jr., saying Weary didn't use enough force against police officers to justify the charge. (MORE)

I knew this smelled like a bunch of crap. The officers themselves effectively admitted that they were wrong.

Now let's see if some of our own forum members are able to do the same.

So as I understood what happened, the judge heard the prosecution's rendition of what happened, read case law presented to her on this subject, questioned the police officers, and then determined that on the basis of HPD's version of events, the legal elements of the offense resisting arrest were absent. This means, the police did not have probable cause to arrest Weary for resisting arrest. Charges dismissed.

This is not a dismissal on a "sneaky legal technicality" or the like. HPD should never had arrested Weary in the first place for the resisting arrest charge.

Does he get to taze the officers? That would be awesome. Clearly a taze for a taze law must be put in the books.
