I've talked to a number of attorneys here today during my lunch break downtown Houston. I work at a law firm. They've all told me that the NFL cannot prevent a person from using life sustaining meds to perform their job. If he indeed has a prescription for the inhaler from a licensed P.A., he has the right to use it to sustain his life and perform his job. They say his case is a slamdunk and the NFL can be sued to no end if he drop his medication and dies on the field if no other medication works for him.

Take this for what it's worth. The attorney's there know how big of a Saints fan I am and they said he has a really strong case. He has lawyers all over the place wanting to represent him. The NFL better back off or they can count on a serious monetary lawsuit from Thomas and the Saints if this move proves to be the one that keeps them out of the playoffs.
 
I use the same medications Advair which has a inhaled steriod in it. It is not an anabolic steriod which would enhance his performance. Additionally I'm sure he has to take predinesone occassionally another non anabolic steriod. None of these would enhance his performance other than allowing him to breath. I've been a respiratory therapist for 17 years and have had asthma for about 10
 
Interesting, if true (not doubting you or your sources, just leaving room for doubt until it happens.) But if they proceed, there must be a lot of confidence that Thomas is not guilty of some undisclosed transgression. I can't imagine he'd willingly subject himself in that type of action if there was something he feared coming out.
 
if Paul Tagliabue were still the commish i'd say Hollis has a shot. With this new guy, the first thing he's gonna want to do is let everyone know he's the boss.....

I don't think he'll budge, even if the suit may hold up in court.
 
You say the below as if you have inside information that the Thomas camp is in fact considering a lawsuit. But you only provide evidence that they theoritically could.

So, do you in fact know that he is considering filing a lawsuit, or are you merely speculating?

Point well made. And if indeed he has done nothing more than use a prescribed asthma medication, I would think that there would be a violation of the Americans with Disabilities Act of 1990. A lawsuit does not surprise me.

I'm no expert, but a court decision should take precedence over any NFL decision. If successful for Thomas, I'd think the NFL's only recourse would be to appeal to a higher court. Ignoring a court ruling wouldn't anymore be an option for the league than for any other entity, IMO.
 
YOu see this is why I think Merriman did in fact use some sort of anabolic steriod. Merriman would not come out and say what he took. Hollis thomas is laying it all out there and really i cant see how he is not innocent
 
He's speculating. But, yeah, an injunction would have to occur sooner rather than later... he can't even practice with the team so I doubt he would miss the entire week of practice and then play.
 
A lawsuit would suprise me. The NFL is not your typical business and this is not about a handicap spot in front of wal-mart. Rules are different. I am not lawyer, do not know many lawyers, and do not doubt Lee Newell knows infinitely more about the law then me.

At yet I would be shocked if Thomas filed any sort of suit.
 
I was listening to WWL today and Kenny Wilkerson read the statement from the NFL that the substance that Thomas tested positive for was not something prescribed to him from his doctor. So I don't know what the basis for this lawsuit would be.
