According to WXMI, the unidentified plaintiff in a civil lawsuit is angry his parents threw away his pornography collection. He estimated it was worth $28,940.72, but he’s seeking $86,822.16 in damages.

But the plaintiff knew something was missing: his porn collection. The defendants reportedly told him they had destroyed the entire thing, which was enough to fill 12 moving boxes.

Can't destroy someone's legal property, I think the guy has a case. The guy stayed in his parents house for 10 months after a divorce, yeah, but the arrangement was voluntary. Not like he forced them to take in him and his stuff.

Or was him having his stuff there conditional upon there being no porn?...that seems doubtful, but if that was the agreement, then the parents had the right to destroy stuff they didn't agree to keep in their home.

The dad said in an email to him something like "the day we found the 12 boxes of porn and sex toys we began the process of destroying them and it took a while to do so." Whaaaa? Did they have to go through some ritual or something? Did they feel the need to shred every magazine and burn every video and toy? Couldn't just throw them in a dumpster? Weird.

Are you sure that's accurate? It seems like the legal side of it would be that if he had something there he wasn't suppose to have, he'd have to leave. Destruction of property isn't something I've heard of as a "right" a landlord has. If I have a dog in an apartment that doesn't allow dogs, they have the right to evict me, but not destroy the dog, right?

No, not sure it's accurate, just speculating. This wasn't a landlord/tenant relationship, it was a "hey, you can stay here." And if the "hey, you can stay here" came along with a "we will destroy any porn if we find it in the house" then I can see how they could have a right to destroy it. Like I said, that seems doubtful. But then again maybe the parents knew about his large porn collection ahead of time and didn't want it in their house.

I don't think the dog analogy really works since a dog is a living thing.

Yeah, but that doesn't really seem like that's what happened here.

He’s an adult. They can’t just seize and dispose of his personal property without legal process. Even if it was a condition of his occupancy, unless he confessed judgment that gave them executory right of seizure (obviously that didn’t happen), they can’t just take his sheet.

They can kick him out but I don’t see how they can seize his property - including his porn. They didn’t have to transport it to him, they could have refused that. But I don’t think they can just trash it (legally at least).

Get divorced over porn and then sue your parents for $80K because they threw away your porn? You just might have a porn addiction.
