A man whose bid to become a police officer was rejected after he scored too high on an intelligence test has lost an appeal in his federal lawsuit against the city.

The 2nd U.S. Circuit Court of Appeals in New York upheld a lower court’s decision that the city did not discriminate against Robert Jordan because the same standards were applied to everyone who took the test.

If you would bother reading and engaging in a discussion, we would all be better served. I stated that the cop over reacted. Guess that is taking up for the cop in your little world.

I think at this stage it is more accurate to state that the cop more probably than not over reacted. While I doubt it is the case since no information about the incident other than the length of the chase and number of shots fired has been released, but potentially the victim could have been in an altercation with the cop - reaching for the officer's weapon. That particular scenario wouldn't be over reacting. However, most likely and I think the reason so many people are bothered by this - the most likely scenario is that he made a gesture that the officer misinterpreted, which would have led to a very tragic over reaction.

It's difficult to lay blame for an incident or for me to understand outrage when no information is out there. I'm saddened that someone had to lose their life, I'm saddened that someone felt they had to take someone's life. I'm heartbroken for the families and friends of those involved, but I can't be outraged yet.

If I find out it was due to a misunderstanding of a hand gesture, I'll be outraged that the officer shot him. If I find out that the victim (and I use victim because I do believe it was most likely a misunderstanding of a hand gesture) had an altercation with the officer and reached for the officer's weapon - I'll be outraged that it was covered at a point that led to the public condemning the officer for his actions.

It's, as always, interesting to watch how these discussions unfold and seeing how some individuals always have an approach to either side with the officers when the officers were clearly wrong or side against the officers even if the officers were absolutely justified.

Police must treat everyone as if they are armed and dangerous.

This causes the police to use leathal force far too often.

Brother we are getting totally stupid with guns. UT allows students to open carry on campus. I kid you not. The chancellor of the school says that students have right to carry.

How stupid is that? Seriously. There are too many fights and other things on campus to allow some crazy ish like that.

You know... while this sounds horrible (and is very tragic)... there's no necessary indication based on anything that's been released that his being deaf had anything to do with the tragedy. Nothing has been released showing or recounting the incident, the only thing that brings up specific concern is the family's assumption that his being deaf is what led to his death.

Not saying that it didn't, but why the outrage over that being the cause when it hasn't been determined yet (or released yet) the events that caused this.

Knowing how manuals are though - the above quote about dealing with deaf being in the manual, does not necessarily indicate appropriate training in handling that type of situation. It very well could be that his being deaf and trying to sign led to his being shot and killed, but any assumption to that point at this stage is only an assumption.

Quite the sordid history he has there. Petty theft and speeding. The [one] resisting arrest charge was dropped. I guess the officer did society a favor then.
 
A few thoughts. But before that, a little background. I am deaf, got my driver's license when I was 15. In Louisiana, there has been the option of putting a deaf driver logo on license plates for as long as I've been able to drive. Not all states are the same. Here in Virginia, there are no requirements to have any identifier. There are no hard and fast rules from state to state on how they deal with deaf drivers.

With that in mind, my previous driving experience, I can easily understand how a deaf driver might miss an emergency vehicle's lights. They often use smart phones to communicate, and unfortunately leads to a lot of texting and messaging while driving. They don't have the same access to hands free communication technologies that hearing people do. So it's not inconceivable that a deaf driver might not notice emergency vehicle lights for a sustained period of time. That's not to mention other scenarios where there may not be a good place to pull over and no way for the deaf person to let the cop know what his intentions are. Deaf drivers also have to take and pass the same courses and tests that hearing drivers do. So to say they're less educated in how to drive just isn't a factual statement.

All that in mind, cops are the ones with a gun in their hand, and cops are the ones capable of controlling how they react to unusual situations, so the onus is on them to use their training to handle unusual and difficult situations in a way that makes good sense and allows deaf people some leeway in allowing them to respond when getting pulled over.

I don't have enough information regarding this specific instance, but it's always prudent for a cop to keep in mind that a driver might be in a situation that doesn't allow for normal communication and respond accordingly. The greater responsibility for these situations lie with the cop's training and handling of unusual stops.

Education goes both ways.

Just because you are deaf does not excuse you from noticing and reacting to emergency vehicles. There is a reason vehicles have mirrors. The "chase" lasted 7 miles.

For 7 freaking miles, the driver never noticed flashing lights! So we also need to educate deaf drivers. What if some person died because he did not see the ambulance behind him and held up the ambulance?


License plates indicating a deaf driver is one step. Educating deaf drivers to check mirrors more often and standard behavior when pulled over. Educating police is also necessary.

I am in no way taking up for the cop as it seems he certainly over reacted. With a little education, training and common sense from everyone, we can prevent such tragedies. It is easy to sit back and blame. How about some proactive steps so we do not continue having these discussions.

I'm of the same mindset:
1. definitely not enough info to have a good opinion on what happened or who is at fault.

2. Definitely the officer's responsibility to handle awkward situations appropriately.

*side note - it'd be great to have a HUD for the deaf to read their texts on vs using their phones*

The only thing I'm sure of is the pointlessness of the post. Mucking up what was turning into a good thread about the relationship between deaf drivers and police is not only not necessary, it detracts others from discussing the topic at hand.

Sam mentioned guns. This was a killing with a gun. Guns laws are needed for civilians and police. It fits...threads go where they go. Calm down.
 
New video shows that he was certainly aware that he was being pursued by the cop. In fact it shows that he intentionally fled from the cops.
