Anyone had any dealings with the fine folks in a Louisiana Family Court lately? They have gone nuts.

Hopefully, some Louisiana lawyers will chime in here, but I had the recent privilage of re-visiting some child support issues with my ex, in court of course. And some of what transpired, blew me away. I won't go into too many details here, but there is one thing in particular that jumped out at me as being grossly unfair.

If one party filed a tax return under a business, for instance, they are allowed to use all their deductions, etc., to arrive at taxable income.

If the other party has only W-2 income, they use the gross income. Period.

Sometimes, things like this make me wish I was a lawyer because that smacks as being inequitable to me. That sounds like a case of the State running over people civil rights. The opportunities for a business owner to write crap off are endless, but the other party doesn't get the same treatment?

I feel like calling the ACLU on them. Anyone else had any dealing with the State lately?

Why not one-up her and start a cult and claim a tax-free exemption?
 
Dont get me started in Louisiana Child Support laws... they are incredibly biased to the women. Case in point, I had a divorce while in college. Instead of taking my actual income to calculate child support they said "you should be working this much, so we are calculating that."

Fine, I am ok with that. Basically they said that even though I wasnt working 40 hours because of college then they would calculate my income as if I was, trying to force me to either drop out of school or get a 2nd job. Again, whatever, I made it.

But now fastforward a couple of years, it's time to revisit the case. they calculate my income and my ex's income... she was going back to school but guess what they didnt say? They never calculated her income based on what she could be making, so again I am hit with 95% of my sons care...

oh and I cannot even use him as ANY kind of tax break even though I pay for everything, she uses him. She gets enough money from me each month to sit on her @ss.. and it's all tax free on her part.

One day, hopefully, someone with money will challenge this ******** sexism.

What kinda cult? I mean do you know something? I'll try anything at this point.

Seriously, I know people who can't even try to do good anymore because they will take it and if things ever go bad and they are not making that kind of money anymore, no matter, they are still required to pay the same amout and be declared underemployed.

You can't get out of the circle unless you do something drastic. I just don't know what.

But no, to my original point, if one party is afforded rights the other party should have those same rights too.

Yeah, maybe. I'm going to look into that.
 
Honestly, the thing that kills good guys is the lot of bad ones. There are so many deadbeat dads who do not wanna take care of their kids that laws are passed for these people. The good ones who want their kids and take care of their kids are kinda thrown by the wayside and no matter what I say there will always be numbers that go against me.

The thing that bothers me worse than anything is that the courts award based on sex instead of merit first.

That is why I brought up the issue. These laws have changed in the last couple of years. The State Legislature has apparently thrown a wide net over the mess and they are now tangled up in what appears to me to be civil rights violations.

And no, I'm not playing around trying to stoke a fire like I do sometimes. I'm dead serious.
 
I believe what the reason it's biased towards women is that many years ago the man was the sole provider of the household. The women didn't have to work and families could make it on one income. Back then if a man or woman left the relationship, since the woman didn't work, she was screwed. No house, no car, no income etc.

Now due to inflation and other things we can no longer make it on one income alone but the laws have remained the same. Time to change the laws.

Not sure where you're coming from here...what we are talking about is how much the laws have changed in the past few of years.

Time changes everything, but the changes still have to be legal.

I'm betting the Louisiana Laws, or the way they are being applied, violate the civil rights of people.
 
I seriously doubt there's any sort of civil rights violation. It's hard to really apply any of the child support laws without knowing the full facts of each and every case, and judges are given pretty wide latitude in child support cases. Judges themselves are probably biased towards women (more than likely?) for the reasons already given here.

What it sounds like, honestly, is that your baby mama's just have better attorneys than yall do.

It has not changed in twenty years. I was told by a judge in 1989 that I was morally obligated to pay for Catholic School. I was going to pay it anyway but since when is heir a mixture of church and State ?

i might be inclined to agree with this, except for the theory that women can be a LOT meaner to women than men may be. It wouldn't surprise me at all if a male judge showed undue sympathy to a maternal claimant. My friend is a family-law attorney - a good one.

i don't believe in court-ordered child support without audit (meaning expense receipts). i think judges should make claimants show where these numbers are coming from. (as opposed to just "stickin' it to your ex")

And i don't think because a parent (male or female) may not earn enough money to exceed necessities, that it should affect the time spent with the child. i think if quality time is the best thing a parent has to offer, that should come into consideration.

But that's just me and my crazy talk.

My father never paid - and i mean NEVER paid - and my mom didn't have the money to hire a lawyer to drag him back for enforcement, and she also didn't have time or energy for the foolishness of court garbage because she had her own job and life. He made sure he spent as much time with me as he possibly could, and i didn't go without anything i needed.
