take what he offers and alter your business practices to avoid this situation again

keep your work, give him nothing, call it a lesson learned.

These are your wise moves.

You're opening up a can of worms that you won't readily be able to close if you aren't careful. You can't fix your business reputation once it's damaged. You screwed up, and you can't expect to get everything you want at this point.

If you sue him, there are a lot of bad things that can happen that you'll regret if you aren't careful.

I wouldn't sue no matter what. It's a bad, bad, bad, move...even if you could win.

I would write him a conciliatory letter, documenting your side of what happened, and expressing a desire to resolve it--and politely stating that if he doesn't want to resolve it, you'll just keep the work and call it a day.

And I'd be willing to take $1000.00 and consider myself lucky.

I think what I need to do is find a loan shark! Anyone know one, the kind that like pay me you know say 300 - 400 bucks and take his debt of 900 and you know if he dosen't pay them they kill him or somethin.


LOL j/k... this happen years ago anyways.....I betcha the interest has accured tons by now. But I just figured I'd let KOS know my ordeal in small claims and how its not always the best route to go because you end up spending more of your hard earned cash, and its not like he is guarenteed to pay ya.

Just as an aside since this is website(s) were talking about.

If the agreement you get from him is to pay you $700 for 6 pages, don't give him the HTML/CSS/images source if at all possible. You can create 6 pages which are simply base HTML with an image which is a screenshot of the pages you made -- assuming they all fit on one screen (not a long legal document that scrolls). That way he can't take the "code" behind your pages and simply create 10-15 other pages that do what he wanted to do anyway just by editing the pages or getting someone to edit the HTML/css/etc behind the scenes.

If that's not possible, take the $700 for 6 pages but make sure the 6 pages you give are the least important ones for the site.

I tried that, he worked at a wing place up here one day a week and I went in there to find him. I was like step outside and lets just get this over with. I figure he would ya know, if it were me (well I would have paid him back) But if I were ever in the situation I would take a good *** whooping for 700 bucks.

He declined, and hid in the back threatening to call the cops, and his co worker (also a friend of mine) was just like, hey man I would be mad if I were you too, all I ask is you don't do anything in here. That was the last I saw him outside of the courtroom. He moved to Maryland shortly after I took him to small claims.


Deadbeats stink, I really hope everything works out for KOS because it sounds like he put way to much time and effort into a project for someone very undeserving and he sould get what he is entitled to.

Again thanks for the advice.. sorry for being MIA the last hour or so our internet was down at work.. suckage.

Anyway the thing about it is I burned him a copy of all files and was going to give him everything that I had done so that if he got someone with web experience they could just tweak out all that he wanted. Obviously I didn't give him the CD

This sounds like the best advice yet. It gives him a chance to make it right, and a chance for you to get some of your money out of the deal. It might not be what the total bill was, but in this case a settlement that is worked out between the two of you might be the best and easiest option, with the least amount of baggage.

I'll never forget this client I had who asked for some extra work done on some cover letters, and after the work was completed, she apologetically said that she had just been laid off earlier than she expected (hence the need for a resume and extra cover letters), and she offered me a ton of skin care samples that she had from a part time venture she had. I took the skin care products, and wow what a deal. I loved the stuff...got a lot more out of that than I would have gotten out of the cover letter fees, LOL. She was happy and so was I. I know you started out with such a barter-type deal, but now simply trying to settle with this guy for less than the charged amount but more than the paltry $700 he offered might be the least painful, most positive-for-all option. JMO...:)

Yeah that's what I'm thinking. I think I'm going to go speak with my brother's attorney and give him all the facts, show him the CD of files etc and see if he thinks I should take action by having him write up a letter and mail it to him.
