Nevada court orders Jon Gruden case to go to NFL arbitration (1 Viewer)

Damn.

Definitely on Gruden's side on this one, mostly because his opposition is Goodell. Was hoping that Gruden could pull Goodell down a few pegs.

Wonder if he is going to take it to the US Supreme Court ...

Yes, it is! That was a major point that Gruden was trying to make (along with his belief that the clause didn't apply to him post-release). The binding arbitration is to be presided over by Goodell.

The problem is that when Gruden was hired he signed a document that included the binding arbitration clause (oversimplified). IOW, he agreed to Goodell arbitrating any issues. Most coaches (all?) have signed something similar. That's why it was so important that he get the Nevada courts to agree that the clause stopped being applicable when Gruden left the Raiders.

The issue of Goodell being the arbitrator was negotiated during the last NFLPA contract and became boiler plate text in coaches contracts as well.

He's not at that stage yet.

Per the article, a three judge panel of the Nev. SC made this ruling. Gruden's lawyer said they would seek a hearing before all seven justices of the Nevada Supreme Court. There's still hope that justice will be served.

Yep. I know that. But I seriously doubt that he is going to get the relief he needs in Nevada.

We know how 3 have voted already. Goodell only needs 2 votes of the additional 4 to win his case in Nevada, while Gruden needs 3 of the remaining 4. And that's IF he gets heard by the entire 7.
