Based on what, exactly?
And I'm not asking that in defense of McAfee, because I don't think it should have been brought up or even alluded to by him. But apparently he never mentioned her by name, and said it was "what the internet is reporting".
Just seems like one of those things that, worst case scenario, will result in him writing a check to her for what may as well just be a speeding ticket for him.
You don't actually have to name someone to meet the legal definition of defaming/libeling/slandering them, just identify them in some way, which he did (called out her college, sorority, boyfriend, etc. on top of sharing a story in which she had already been named online).
Saying "allegedly" doesn't give him any kind of automatic pass, either. The original source for the story was YikYak, an app used mostly on college campuses to anonymously bash people and spread rumors. He had absolutely no reason to signal boost this story. And that's not even getting into the harassment that happened tp her and her family after he did.
I'm not saying she would win. Defamation is hard to prove. And the most likely outcome is still probably a settlement. But McAfee was bring an absolute dipshirt by even sharing this story.
His best defense may be to just say he's stupid. Which he is.
