Woman wins $5.2 million suit against GEICO for catching STD in a car (1 Viewer)

Was this recent or long ago?
last time was about 10 years ago, first time was around the early 00's. as a non-policy holder, both times were a bad experience in receiving payout.

first was being rear-ended (lol) making a right turn. the girl who hit me was maybe 18 and i felt bad for her. her father was in the passenger seat teaching. zero issues at all dealing with the dad, in fact, he's the reason i was able to get the claim resolved, and even offered to pay me the difference in cash if it continued to drag on.

my problem was the payment amount as it was a few thousand under. my friend's dad was a car salesman and was able to get me the wholesale value in writing (i did buy it from him..) and the offer was below that. i did not owe anything on the car, but the amount quoted to me was way off the appraisal on their end (took way too long to get a copy of). little tick tack stuff, like manual transmission, -$500 off, etc., and i was ok with the deductions, except, the appraisal had already taken these into account. ultimately i was paid the exact amount from the appraisal, but the work put into getting it was almost not worth it. *sniff* i actually liked that sheetty car.

second was my wife using my car and her coworker ran into it while backing out. the damage wasn't that bad, mostly a rim, tire (which the collision center would only replace as a pair), and an alignment. ultimately, not a big deal. wrong. double wrong. even though i brought it to the place recommended by geico, it took 8 weeks for the work to be completed because of all the hang-ups. good thing i didn't request a rental, i'd still be waiting on reimbursement.

I've had very good luck with Geico. Two totalled vehicles (rear ended and a tree fell on another), and no troubles at all.
same here. I was rear ended by a man arguing with his son on his cell phone. Both of us had Geico. My car was towed
to a local body shop. There was an adjuster waiting. He did his thing and luckily my car wasn't totaled. He printed a
check in the parking lot and I got my car back a few weeks later.

i'm not even mad. fork geico and their sheetty customer service.

Geico has always been great for me. We recently had to change because of the saving with our home insurance and combined with a rate hike Geico wouldn't move off of, it was impractical to stay. Now I'm dreading having to ever use my policy with All-State, but it was a huge difference from what Geico was offering for the same coverage.

i'm sure they're great to their customers. i have usaa and i bet it is the same experience for those not a customer.

Yeah, if you're not a customer, I don't think you'll get the same treatment from most insurance companies, mostly because they're representing their customers in accidents.

The arbitrator is stupid and ridiculous and the law is highly deferential to arbitration awards.

Here I’m sure that at some point GEICO adopted a policy favoring arbitration because it’s cheaper in the macro. Score this on the red side of the ledger.

so just got more info on it.

GEICO denied the initial claim AND denied "defense coverage". So the car owner and plaintiff went to arbitration.

GEICO policy verbiage " we will pay the amount you are legally obligated to pay"

Shoulda defended the client outright, instead of denying defense.

Geico is off the hook, at least for now, from paying $5.2 million to a Missouri woman who alleged she contracted a sexually transmitted disease in a car insured by the company.

The Missouri Supreme Court on Tuesday ruled unanimously to overturn a lower court's ruling that favored paying the woman. Instead, the state Supreme Court judges said Maryland-based Geico should have had a chance to weigh in sooner and sent the case back to the lower court for further deliberation.

The case drew attention last year for its unusual legal strategy, with the woman claiming she caught the human papillomavirus (HPV) from having sex in 2017 with a male partner in his 2014 Hyundai Genesis, which was covered by Geico, according to a 2021 complaint. The woman, identified as "M.O." in the court documents, claimed the man was aware he had HPV but failed to tell her, leaving her with "past and future medical expenses" and "mental and physical pain and suffering."

HPV can cause cervical cancer, certain other cancers and genital warts.

In February 2021, M.O. alerted Geico she was pursuing legal action against the man, claiming that the car insurance policy should cover her injuries and financial losses. According to the complaint, she asked Geico for $1 million. "Let me know," she wrote..............
