So why does the accomplice face murder charges? Must be missing something.

Participation in felony + death of person during commission thereof = felony murder. Not only is it murder, but it used to qualify for the death penalty, until the Supremes ruled that the death penalty can't be imposed on someone who didn't have intent to kill (or "reckless indifference").
 
Good for her. What sucks is she will still probably have to come up with 40K+ to cover her legal expenses when the intruder's family decides to sue her in civil court.

Oh yeah! I forgot about the guy who's hooker wife went missing after she went to the McDonalds to meet a couple of 'dates'.

Oklahoma is a castle doctrine state. If she is found to have acted within those guidelines (which she will from the information we have at the moment), than she will automatically be granted immunity for any actions she took defending herself from any civil or criminal suits.

Oklahoma is a castle doctrine state. If she is found to have acted within those guidelines (which she will from the information we have at the moment), than she will automatically be granted immunity for any actions she took defending herself from any civil or criminal suits.

Would Louisiana happen to have similar laws on the books?
 


Yes. However unlike Texas or Florida, it doesn't give you the right to simply gun down people you find on your property.
They have to present a threat to your person, another person, or your actual home. So it is not legal to gun them down if they are breaking into your tool shed or unoccupied car.

I have problems with some of the laws attached to Texas and Floridas Castle Doctrine, but I have no issues with the basic premise that you have the lethal authority to protect yourself from anyone breaking in to your home.


Texas, however, had a case where a college student was staying with his sister for a week. Was drunk coming home and went to the neighbors house instead of her house. All evidence says he just tried opening the front door, but it was locked and than stumbled back out to the street. The owner of the house came rushing out and fired 5 times into the back of the 19 year old student and killed him 40 yards into the street. He claimed that not only did the 19 year old come in (no evidence of break in) to rape his wife, but that he charged him in the driveway. The man was found not guilty.

It was similar to the case that happened here in Louisiana in like 93 where a Japanese student was going to a halloween party, rung the door bell to the wrong house, and was walking back to his car when the owner of the house came out with his gun and told him to freeze. The Japanese student thought he said please and turned around when the man shot him 2 times and killed him. He was also found innocent.


So while I support the basic premise of Castle Doctrine. It shouldn't give you the right to gun down anyone you want too like states are allowing.

Wow. My niece lives in Blanchard. Completely justified, IMO, but I give her kudos for thinking clearly enough to be on the phone with a dispatcher up to the shooting.

A friend of mine once shot an intruder inside her home, but he managed to stumble outside the home before falling to the ground. He died in her front yard. Even though the evidence strongly suggested that he was several feet within the home when shot, she was still convicted of manslaughter because he wasn't in the house when police arrived. :(

wow... what bs. note to self, if they crawling. shoot again.
