I have Red light camera ticket question. (1 Viewer)

Have anyone ever beaten one in court. I just receive one for doing 35mph in a 25mph zone.

You can't even go to court for them, unless you want to file suit against Redflex. They're civil.

We just recently voted to do away with the red light cameras!

I got one at the first light off the causeway bridge going south. I was over the painted white line when the light went red but I had not reached the intersection of the crossing street (this line was shown in the photo only!). I called about it but had no recourse. I was also a little over the speed limit but they did not add speeding to the ticket.

At least you got to vote them out. We here in Jefferson Parish never had a say in whether or not they were they should go up in the first place. Now they are in shut down mode because of financial links between Redflex, lobbyists, and elected officals. All of the fine money is still stuck in escrow due to various pending lawsuits against the system and the limited ability to fight them in court.

And the irony is that Redflex has threatend to sue the parish to get them turned back on because they want their money.

I'm assuming you're referring to Causeway and 17th Street. As far as I know, Jefferson Parish's cameras don't have speed detectors.

And for the original OP, I assume you were in Orleans Parish because their system is still running and has the speed cameras too. And I doubt you'll be able to win any fight in court and it will cost you more if you lose. You're probably better off paying the fine unless you have a real good reason (like you were on the way to the hospital) and you can absolutely prove it.

I love red light cameras but I hate speed cameras.

How good was the picture?

I got one for turning right on red (without coming to a complete stop first). $135

The JP ones detect speed, because they tell you how fast you were going at the time, but they are not triggered to take pictures for speeding. The pictures are a surprising high-resolution. I know because my wife got one at Causeway and Vets.

While each state is different you have the right to question your accuser or officer. In this case your officer/accuser is a camera which cannot respond to your questioning and can't even show up in court. In new Mexico a very close friend did beat the ticket but she was in law school and beat em by the book of law (that's how I know you have a lawful right to question your accuser

Wife got the same thing. Here's the funny part: the ticket she received in the mail said she would not be charged with a moving violation--just pay the fine--it may have even said something about it being non-contestable...can't remember. But they definitely just wanted the money.

Challenge them on being a registered private security company at the state level. In Texas several tickets were overturned because the red light company was not registered as a private investigation company in the state with a right to perform process service.

That lawsuit failed in Louisiana.

My comment to the OP is this. Were you speeding? If so, pay your fine.

Do they physically show you or just your car? If they don't show you personally how can they prove it was you driving. You don't have to admit it on self incrimination. Burden of proof is on the procecution.

The problem that I have with this is that in every case of an officer issued ticket you have the opportunity to face your accuser in a court of law, a basic inalienable right. The system makes court dates available specifically for these challenges.

These cameras offer no such challenges as the courts will typically not hear a case where the cameras are concerned and you're not even offered the opportunity to have a hearing.

The 'violation' is deemed a civil, not criminal, offense. It will not appear on your driving record and the stiffest penalty possible is that the camera operator can report it to the credit reporting agencies.

Is this the suit that failed?
