Yes. Leaving your beer unattended was an invitation for someone to rim it. Just like passing out in the common area was an invitation to have your eyebrows shaved off and other indignities performed on your body. If you made it to your room, messing with you was off limits but conking out drunk in the common areas...

She said “for the rest of her life,” which implies that this is a viral, not bacterial or protozoan infection. So that rules out syphilis, gonorrhea, chlamydia, yeast infections, trichomoniasis, etc.

Leaves HIV (probably not, and would potentially carry an attempted murder charge if it were), Hep B (definitely possible), Hep C (unlikely as there’s no discussion of blood), HPV (definitely possible, but perhaps a conversation about potential cancer would have been mentioned), and herpes (definitely possible).

And we’re not just taking her at face value—there’s video of the act and they both tested positive for the same STD. That’s about as good a case as you can make.

Is it really as good of a case as can be made? I think this is still missing the threshold question - can an STD be transmitted that way? It’s really a medical question - were we litigating this as a legal case it would require expert testimony.

There are two other ways besides the “dick in the water bottle” theory that these two people can have the same STD. One is that they had sex and the other is that it’s coincidence (I suppose modern lab analysis can probably connect two infections by specific strain/genome if that was done but that’s probably expensive).

Some quick research (that would be awkward for me to explain to my wife 😆) seems to show that it’s possible though believed to be rare. The main reason why it is rare is because these infections don’t survive outside of the body for very long (like minutes).

Most likely candidate is some kind of oral herpes infection. I’m not saying I don’t believe the story, I just want to know more about this alleged mode of transmission.

This is a messed up situation all around.

But I am a little curious- are we talking about the common water bottle, the 16-oz with the little small opening? You would have to have like a toddler’s penis with lil mouse balls to make that work. :shrug:

Well, yes. You would want an expert to say "Absolutely" instead of @brandon8283's less dependable browsing-a-football-forum-while-at-work testimony, but I'm sure it wouldn't be hard to come by.

While there's probably very little precedent for making sweet love to a Dasani as a route of transmission, I'm sure an expert would be happy to make the case that surfaces exposed to genitals are temporarily infectious for certain STDs, and if those surfaces came in contact with someone's mouth within a reasonable amount of time, then yes, transmission would absolutely be possible.

Your link to "sharing a water bottle" with someone is obviously not the same thing as sharing a water bottle with someone's dick.

There is video evidence of the "indecent assault" that he is being charged with. If he tests positive for the STD and she now has it, yes there's a defense argument that could be made, but barring any evidence of a prior relationship between her and the janitor (which seems unlikely at this point), it would fail and he would also be convicted of the aggravated assault with a deadly weapon.

Genome evidence probably not necessary with evidence or with a distinct lack of evidence of a prior relationship between the two.

Further, it probably doesn't matter if she got the STD from him or not. There is clear evidence that "aggravated assault with a deadly weapon" occurred, as having video that shows he put his STD-infected genitals in contact with her water bottle is already proof that the assault with a deadly weapon occurred, whether or not the assault was successful.

If I attack you with a knife but don't manage to cut you, did assault with a deadly weapon not occur?
