The fiance and killer of the domestic violence murder victim Gabby Petito desperately called his parents and told them that she was “gone” weeks before she was discovered dead – yet they later shared messages expressing hope that search efforts for her would end in success, her family has alleged.

Petito’s parents, Joseph Petito and Nichole Schmidt, made the claim in a lawsuit that they are pursuing against Brian Laundrie’s family and their attorney in the latest chapter to a case that has generated international news headlines.

The Petitos, who amended the lawsuit with the new allegations on 30 November, have accused Laundrie’s parents as well as their lawyer of intentionally withholding information about their daughter’s murder, inflicting on them pain and emotional distress.

The Petitos allege that Christopher and Roberta Laundrie received “a frantic telephone call” from their son on 29 August 2021 in which he said his betrothed Gabby was “gone” and that he “needed a lawyer”.

That same day, the Petitos allege, Christopher and Roberta Laundrie spoke with a lawyer, Steven Bertolino. The Laundries, from Florida, are accused of telling Bertolino that Petito was “gone” and their son needed an attorney.

Four days later, on 2 September 2021, the Laundries had paid Bertolino to retain his services, and he in turn entered into a fee agreement with a criminal defense law firm in Wyoming, the state where Petito would later be found dead.

Petito’s mother reported her missing on 11 September 2021, setting off a search effort around Wyoming’s Grand Teton national park, where she had planned to travel with Laundrie. Three days after she was reported missing, Bertolino issued a statement on behalf of the Laundries reading: “It is our hope that the search for Miss Petito is successful and that Miss Petito is reunited with her family.”

Meanwhile, the day after his call to his parents, Laundrie sent a text message from Petito’s phone to her mother saying there was no cell service where they were, the amended lawsuit notes. Nichole Schmidt now interprets that text as an attempt to “deceive [her] into believing that Gabrielle Petito was still alive”.……

I hate the "prove me wrong" thing, but I think this is one of the very rare cases when there is a single, right answer.

"Are you 100% sure that she is dead?"

"Yes"

Find a lawyer and connect him with your son. Then immediately call law enforcement and tell them what you know.

Of course, it's a heartbreaking thing to do. But it's the only right thing in my mind.

The posture is a bit hard to follow but what I think has happened is that the Petito family won a $3 million judgment against Brian Laundrie's estate for wrongful death - and in "settling" the case, the Laundrie parents agreed to not appeal the judgment. The "settlement" doesn't mean the Petito family was paid, because I don't think Laundrie's estate has any money.

So the Petitos have another suit in Florida against Laundrie's parent's directly, which appears to be based in intentional and/or negligent infliction of emotional distress. That's the case where this new information is coming from - as the Laundrie parents were recently deposed.

There is also a third suit against the Moab police department in Utah.

Of course, it's a heartbreaking thing to do. But it's the only right thing in my mind.

This is where I think the claim for intentional infliction of emotional distress has some traction. One of the elements is that the conduct must be "outrageous" - which is typically defined along the lines of shocking conduct that the general public knows not to do. In Florida, apparently the intent to cause the plaintiff harm also includes reckless conduct, which by definition isn't the same as direct intent.

So if the record shows that this conduct by the Laundrie parents was, in the court's view, outrageous and reckless under the legal standards, this could actually resolve in the Petitos favor. It's not clear if there are any insurers involved.
 
The families of Gabby Petito and Brian Laundrie have reached an out of court resolution, avoiding the need to go to trial over “emotional distress” claims later this year.

The “confidential resolution” was announced on Wednesday in a joint statement from Joseph and Tara Petito and Nichole and James Schmidt. The parties had agreed “reluctantly” to the resolution, the statement said.

“After a long day of mediation, a confidential resolution has been reached between the parents of Gabby Petitio, the parents of Brian Laundrie and Attorney Steven Bertolino to which all parties reluctantly agreed in order to avoid further legal expenses and prolonged personal conflict.


“Our hope is to close this chapter of our lives to allow us to move on and continue to honor the legacy of our beautiful daughter, Gabby.”

Petito’s parents accused the parents of her fiance of knowing that their son had killed their daughter but deliberately concealing information. Christopher and Roberta Laundrie said they did not know that Brian had killed Gabby but Ms Laundrie admitted the thought “probably went through my mind”.…….

Presumably, his mother is not a sociopath, or abused as a child, or suffering from some other mental illness. Just a plain lack of morality, and a selfish mindset. I forking hate people sometimes.

“Just please stop crying and stop calling me names because we’re a team and I’m here with you,” she wrote in the letter. “Yes, I can be a child sometimes, I know, but it’s cause you give me this energy and I just love you too much, like so much it hurts. So you in pain is killing me. I’m not trying to be negative but I’m frustrated there’s not more I can do.”

She said she hopes Laundrie understands that "when I'm upset it's cause I love you too much".……

We must teach young ladies how to recognize and HEED these warning signs. There are so many red flags here. "When I'm upset it's cause I love you too much"? No, baby girl, no. Instead of writing this letter, you should have been RUNNING AWAY.

Young men too. Not sure if you followed it but Gabby actually did get physical too - she was actually arrested earlier on the ill-fated trip when they were pulled over. Not she would have killed him or was to blame.

The whole relationship was toxic. Two people with incredibly low self esteem.

I always have to be careful because people like to claim you're "victim shaming" when you dare to speak to the relationship mistakes of the young. She was def. a little OCD by wanting things just so and got frustrated and it manifested by lashing out but by no means was that a violent or controlling act. But mostly, as a young woman, she was confused by what love is and this relationship should have been a life lesson in toxic people that she moved on from.

Yeah, it's kinda the serious version of the Bill Burr domestic violence bit. Certainly there's often a "good reason" for a guy to want to hit a woman but, call me old-fashioned, there's never a reason to lay hands on a woman unless there's a realistic fear of grievous bodily harm. And that poor little twig of a thing was never gonna grievously harm Laundrie.

It definitely seems like running away (or more generically breaking up from a toxic relationship) is contrary to the wiring of the young adult mind. I was in a toxic relationship in my 20s and had a very hard time leaving, stayed in it for two years past when it was obvious that I shouldn't have.

I suppose that young adults, especially ones that have now defined themselves and their comfort space by the relationship, don't have the confidence it takes to make the right decision. It is frightening - more frightening than the toxic relationship. As you get older and more fully develop that sense of yourself (that we now know lasts well into the mid to late 20s physiologically and perhaps even later emotionally) it's easy and wise to look back and say 'what the hell was I doing'? Or 'she should have run' but the 22-year old is challenged see it that way.
